Galaxy Theatres, LLC, a California limited liability company (“GT” “we”, “our” or “us”) has implemented this Privacy Policy (“Privacy Policy”) for its galaxytheatres.com website (including all areas of the site) (the “Website”), applications and software provided online and made available offline through or in connection with the service, including through a mobile device (collectively, the “Service”) to provide our registered users (“Members”) and unregistered users and visitors (collectively “Users” or “you”) information regarding the collection and use of your information on the Service, so that you can make an informed decision about your use of the Service. Capitalized terms that are not defined in this Privacy Policy have the meaning ascribed to them in our Terms of Use.

When using the Service, there are general elements of our Service that you should know. We will not use or share your Personally Identifiable Information with anyone except as described in this Privacy Policy. GT does not own your user generated content. The Information We Collect

    2. Purchase Transactions. We will ask you to provide certain information if you choose to purchase products on our service, including Personally Identifiable Information and credit card information.

    2. Clear GIFs/Beacons. When visiting our Website, we may also use “Clear GIFs” (aka “web beacons” or “pixel tags”) or similar technologies in our Website and/or in our communications with you. A Clear GIF is typically a one-pixel, transparent image located on a web page or in an e-mail or other type of message, which helps us to verify an individual’s viewing or receipt of a web page or message. Clear GIFs allow us to know whether you have viewed a web page prior to visiting our Website and may enable us to relate such information to other information, including your Personally Identifiable Information. We use non-Personally Identifiable Information, such as anonymous Website use data and IP addresses, to improve the quality and design of the Service and to create new features and services by storing, tracking, and analyzing your preferences and trends. GT will not share your email address with advertisers or unaffiliated third parties without first obtaining your express permission.

GT will share certain data, including that you completed a purchase transaction with us, to our third-party advertising service providers in order for them to provide additional offers to you from unaffiliated third party vendors.

We may provide information, including personal information, to our subsidiaries, affiliated companies, or subcontractors, so such parties can, among other things (a) perform services and/or process such information on our behalf, (b) use the information to offer greater functionality and enhanced services through the Service and provide you with additional product and service opportunities, and (c) communicate these opportunities to you. In the event you provide personal information of a third party in connection with your purchase of a Galaxy Theatres gift card for such third party, we may share both your information and the intended third party gift card recipient’s information you provided with our third party gift card distribution provider for fulfillment of your purchase.

We may share non-Personally Identifiable Information (such as anonymous Website and/or Application use data) with third-parties to assist them in understanding our Service, including Users’ use of our Service and the services we provide and the success of advertisements and promotions.

We may share non-personally identifiable aggregated user data, such as aggregated gender, age, geographic, and usage data (without the inclusion of a user’s name or other identifying information) to advertisers and other third parties for their marketing and promotional purposes.

Rights to Opt-In / Opt-out

You have the right to “opt in” and/or “opt out” of certain of our uses of your Personally Identifiable Information. For example, you may have the opportunity to elect whether you would like to receive correspondence from us and/or third party service providers. Your personal information will not be shared with third party service providers unless consent is given by you. You will have the opportunity to opt out of our promotional e-mails by clicking the “opt out” or “unsubscribe” link in the e-mail you receive. Our Commitment to Children’s Privacy

Protecting the privacy of young children is especially important and is mandated by U.S. law. For these reasons, GT does not knowingly collect Personally Identifiable Information on the Service from persons under 13 years of age, and no part of our Service is directed to persons under 13. If you are under 13 years of age, then you must not use or access the Service at any time or in any manner or provide any information to the Service. Retention Period

Accordingly, even if you close your account we will retain certain information as necessary to meet our legal obligations and fulfill the purposes outlined in this Privacy Policy.

We retain your Personally Identifiable Information even after you have closed your account if reasonably necessary to comply with our legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, enforce our Terms of Use, or fulfill your request to “unsubscribe” from us. We will retain de-personalized information after your account has been closed.

Information you have shared with others (e.g. comments, posted reviews, group posts) will remain visible after you closed your account or deleted the information from your own profile, and we do not control the data that other Account holders copied out of our Service. User Content associated with closed accounts will show an unknown user as the source.

International Users

The Service is hosted in the United States and are intended for and directed to Users in the United States. The Service is void where prohibited. If you are accessing the Service from outside the United States, your use of the Service is governed by U.S. law, you are transferring your Personally Identifiable Information to the United States, and you consent to that transfer.

By providing Personally Identifiable Information to us through this Service, you agree that it may be used by us and our Affiliated Parties for the purposes described herein and you further understand and consent to the collection, maintenance, processing and transfer of such information in and to the United States and other countries and territories, which may have different privacy laws from your country of residence and which may afford varying levels of protection for your Personally Identifiable Information. Online Tracking Disclosures -- “Do Not Track” Settings

You may be accessing the Service via a browser that has a “Do Not Track” setting. Under AB 370 of CalOPPA, we are required to disclose our response to a browser’s “do not track” signal. From time to time, you may have the opportunity to provide Personal Information in exchange for discounts and price differences. For example, we require certain information in order for you to participate in our Galaxy Theatres Rewards program. Members of Galaxy Theatres Rewards receive discounts on concessions, free movie tickets, birthday rewards, and additional incentives based on having an account and agreeing to receive email messages from us where we offer and provide incentive opportunities. Categories of Personal Information that we may collect when you sign up for a rewards program accountnclude your name, email address, phone number, zip code, and birth date.

How to Opt-In and Right to Withdraw

Signing up for our Galaxy Theatres Rewards program is optional. By providing your Personal Information during the Galaxy Theatres Rewards sign-up process, you affirmatively opt-in to receiving the financial incentive offered by our program. You have the right to withdraw from the financial incentive at any time. If you opt-out of receiving a financial incentive, GT will not reduce the value of any financial incentives you previously received from us. You may withdraw from Galaxy Theatres rewards at any time by deleting your account on the Service, or by sending a message to info@galaxytheatres.com.

Relationship between the Financial Incentive and the Value of Your Personal Information

The financial incentive or price difference you obtain as a member of Galaxy Theatre Rewards is reasonably related to the value provided by your Personal Information. We take into consideration, without limitation, the anticipated revenue generated from such information, the anticipated expenses which we might incur in the collection, storage, and use of such information, and the anticipated expenses which we might incur related to the offer, provision, and imposition of the loyalty program. Based on this framework, the value of your Personal Information that allows us to make these incentives and offers is the value of the offer itself. Note that offers and financial incentives may vary by location and may not be available in all locations. The value of such incentives may also vary by location even if the offer itself is identical across locations.

Sharing, Selling, and Disclosure of Personal Information

GT shares certain aspects of your information with third parties for advertising purposes, in controlled circumstances as discussed below.

We may display contextual advertising on our Service, which is dependent on your activity on the Service. If we do display such contextual advertising, we may customize such advertisements using data processed based on your current interaction with the Service (e.g., time, general location). We may also document and audit ad impressions and related data relating to the delivery and display of contextual advertisements. Currently, contextual advertising on our Service occurs solely after you complete a purchase of a product on the Service. In the event you do not engage in purchase transactions, or you engage in but not complete a purchase transaction (e.g., you begin to buy a movie ticket but do not complete all of the steps necessary to conclude the purchase) you will not receive contextual advertising and your information will not be shared.

Response Timing and Format

We endeavor to respond to a verifiable consumer request regarding the right to know, access, delete, or correct within forty-five (45) days of its receipt. If we require more time (up to a total of 90 days), we will inform you of the reason and extension period in writing.

For verifiable consumer requests regarding opt-outs, or the right to restrict Sensitive Personal Information, we will respond within fifteen (15) business days of its receipt.

Any disclosures we provide will only cover the 12-month period preceding the date of our receipt of the verifiable consumer request. Under California’s “Shine the Light” law (California Civil Code §1798.83), California residents who provide personal information in obtaining products or services for personal, family or household use are entitled once per calendar year to request and obtain from us information about the customer information we shared, if any, with other businesses for their own direct marketing uses.
