These terms and conditions apply to the Galaxy Rewards Program, a loyalty program offered by Galaxy Theatres LLC. Participation in and use of the Galaxy Rewards Program constitutes agreement to these terms and conditions.
Membership is open to residents of the United States and its territories who are 13 years of age or older. Membership is valid only at participating Galaxy Theatres locations.
By joining the Galaxy Rewards Program, members agree to receive informational and promotional emails, unless the member has expressly opted out of receiving such communications.
Galaxy Rewards accounts, cards, points and rewards are non-transferable, except to a new card for the same member in the event of a lost or stolen card.
Rewards have no cash value, may not be purchased, and are not redeemable for cash under any circumstances unless required by law.
Members may cancel their membership at any time. Any accrued points and/or rewards must be redeemed prior to account cancellation or they will be forfeited by the member.
Galaxy Theatres may terminate a membership, without notice, for any reason in our sole discretion, including, without limitation, our belief that a member has violated the rules of the Galaxy Rewards Program or intent of this agreement.
Participation in and use of the Galaxy Rewards Program is at the member's sole risk. Program benefits are provided only on an "as is" and "as available" basis. Galaxy Theatres and all of its affiliates, partners, directors, officers and agents expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Galaxy Theatres and all of its affiliates, partners, directors, officers and agents shall not be liable for any indirect, incidental, special, consequential or exemplary damages resulting from the use or inability to use the Galaxy Rewards Program or any of its benefits, unauthorized access to or alteration of a member's program data, or any other matter relating to the Galaxy Rewards Program.
This agreement, and the respective rights and obligations of the parties hereunder, shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any dispute or claim arising out of or relating to this agreement or the Galaxy Rewards Program shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment on the award shall be final and may be entered in any court having jurisdiction thereof. Any such dispute or claim shall be arbitrated on an individual basis and shall not be consolidated with any dispute or claim or any other party.
Galaxy Theatres may change the terms of this agreement at any time without notice or liability by posting a revised agreement on the Galaxy Theatres website located at www.galaxytheatres.com. Any change shall take effect immediately upon posting, unless otherwise noted.
